Ukraine

Ukraine regularly submits data on hate crimes to ODIHR. In 2019, the National Police of Ukraine and the Ministry of Internal Affairs worked with ODIHR to publish an information booklet on Categorizing and Investigating Hate Crimes in Ukraine: A Practical Guide. Ukraine's National Human Rights Strategy includes an objective to "create a system for preventing, combating, documenting and investigating hate crimes". In 2020, a working group co-ordinated by the Human Rights Commissioner of the Ukrainian Parliament was created to improve hate crime recording procedures.

National developments

On 10 February 2022, representatives of the National Police took part in an online presentation of the annual report of the Nash Svit civil society organization (CSO) on "United against violence. The situation of LGBT people in Ukraine in 2021". On 12 July 2022, representatives of the National Police took part in an online working meeting to discuss opportunities for co-operation within the framework of the Council of Europe's anti-discrimination projects on “Protection of national minorities, including Roma and linguistic minorities in Ukraine", and on "Strengthening access to justice through non-judicial redress mechanisms for victims of discrimination, hate crimes and hate speech in Eastern Partnership countries."

During 2022, two online trainings were conducted for police officers in the Transcarpathian, Kyiv, and Odesa regions, together with the Roma Women's Fund "Chirikli" CSO and with the support of the German Embassy in Ukraine. The training events aimed to establish dialogue between police and Roma communities and promote respect for and the protection of human rights as part of a "Strategy for promoting the realization of the rights and opportunities of persons belonging to the Roma national minority in Ukrainian society for the period until 2030."

KEY OBSERVATION

ODIHR recognizes Ukraine's efforts to report hate crime data and information to ODIHR. However, based on the available information, ODIHR observes that Ukraine's hate crime recording and statistics do not sufficiently distinguish hate crimes from other crimes. In addition, ODIHR observes that Ukraine would benefit from raising awareness among and building the capacity of criminal justice officials to address hate crimes.

ODIHR recalls that in Ministerial Council Decision 9/09, OSCE participating States agreed to a common definition of hate crime and committed to collecting reliable data and statistics on hate crimes. To that end, hate crimes need to be distinguished throughout the recording and data collection process from acts constituting incitement to hatred or acts of discrimination. Participating States also committed to introducing or further developing professional training and capacity-building activities for law enforcement, prosecution, and judicial officials dealing with hate crimes. ODIHR stands ready to support Ukraine in meeting its relevant commitments through the provision of comprehensive resources and tailored assistance in the area of hate crime recording and data collection, as well as by providing further resources and tailored capacity-building assistance for police, prosecutors, and the judiciary.
